1. GOVERNING LAW
USEDSPRAYDRONES.COM, a Missouri Limited Liability Company (LLC), operates as an online marketplace facilitating the sale of drones and related equipment through live and timed auctions. All transactions, disputes, and any legal matters arising from the use of this platform shall be governed by and interpreted in accordance with the laws of the State of Missouri, without regard to its conflict of law principles.
By participating in any auction, buyers and sellers agree that any legal action, claim, or dispute related to USEDSPRAYDRONES.COM must be resolved exclusively in the state or federal courts located in Missouri. Participants further agree to submit to the personal jurisdiction of these courts for the purpose of resolving such disputes.
2. LIMITATION OF LIABILITY
USEDSPRAYDRONES.COM is an independent online marketplace facilitating the sale of drones and related equipment through online timed and live auctions. USEDSPRAYDRONES.COM does not own, inspect, or take possession of any items listed for sale and acts solely as a venue to connect sellers and buyers.
Each drone or item sold on this platform is offered “AS IS” and with all defects. USEDSPRAYDRONES.COM makes no warranties, express or implied, regarding the merchantability, functionality, condition, or fitness for any particular purpose of any item listed. All representations about a drone’s condition, history, or specifications are provided solely by the seller. Buyers are responsible for conducting their own due diligence before placing a bid.
USEDSPRAYDRONES.COM is not responsible for any loss, damage, injury, or malfunction of any drone, accessory, or related equipment before, during, or after the sale. In the event of a dispute between a buyer and seller, USEDSPRAYDRONES.COM acts only as a facilitator and shall be released from all liability upon the transfer of any funds or information to the relevant party.
By participating in any auction, buyers and sellers consent to receive electronic communications, including emails, text messages, and phone calls regarding auction transactions. Opting into these communications is required for participation.
3. Buyer Registration & Payment Terms
Every potential buyer must pre-register before placing bids on USEDSPRAYDRONES.COM. We reserve the right to accept or reject any buyer registration at our discretion.
International bidders are welcome. However, all payments must be made in U.S. funds, and a valid form of identification is required.

A 3% buyer transaction fee will be added to the final bid amount to determine the total purchase price. A 3.5% convenience fee applies to all credit or debit card transactions.
If you win an auction, you must contact the seller within 48 hours to arrange shipment and final delivery of the drone. Payment must be confirmed first before the seller is required to release the drone. USEDSPRAYDRONES.COM is not responsible for arranging shipping but provides a connection to shipping providers for convenience.
By registering and placing bids, buyers agree to these terms and conditions.
4. Online Displayed Equipment Information Errors and Announcements
All specifications, descriptions, and details displayed on USEDSPRAYDRONES.COM have been provided by the seller and have not been verified by USEDSPRAYDRONES.COM. The accuracy of all information regarding listed drones is the sole responsibility of the seller. While certain details may have been obtained from third parties on behalf of the seller, it remains the seller’s responsibility to verify the accuracy of such information.
USEDSPRAYDRONES.COM and its representatives assume no responsibility or liability for errors, omissions, or any verbal or written statements regarding drones listed for auction. If a prospective buyer has any doubts or concerns about the displayed information for a drone, they should contact the seller directly before placing a bid.
5. Warranties and Expressed Limited Warranties
Buyers are encouraged to thoroughly inspect and evaluate any item before placing a bid or making a purchase. At their own expense, potential buyers may arrange for a professional inspection of an item before the auction ends, with the seller’s permission. Buyers cannot request a full pre-sale inspection after completing a purchase.
USEDSPRAYDRONES.COM makes no express or implied warranties regarding the condition, functionality, merchantability, or fitness for a particular purpose of any item listed for auction. All items are sold “as is” with any existing conditions or defects. Any guarantees made by the seller are strictly between the seller and the buyer.
Buyers also have the option to test or inspect an item, where applicable, before bidding. Inspections must be conducted before the auction ends, not after winning a bid.
All bids are legally binding and cannot be retracted.
6. Seller’s Right to Bid & Bidding Policy
This auction is conducted “with reserve,” meaning the seller reserves the right to place bids to protect the desired sale price of the item. USEDSPRAYDRONES.COM reserves the right to bid on behalf of the seller up to the reserve amount. If the seller or their representative places the final bid equal to or greater than the reserve, the seller will be responsible for the applicable commission fees.
USEDSPRAYDRONES.COM is not responsible or liable if a listed item is sold or remains unsold, as auction results may vary. Additionally, USEDSPRAYDRONES.COM is not responsible for fraudulent, non-paying, or problematic bidders and is not obligated to reimburse sellers for any costs or fees associated with unsold items due to such bidders. No guarantees are made regarding auction results or final sales.
7. Bidding Process, Disputes, and Malfunctions
USEDSPRAYDRONES.COM reserves the right to reject any bid at its discretion. If a dispute arises between two or more bidders, USEDSPRAYDRONES.COM will determine the resolution, and that decision will be final and binding for all parties.
In the event of a known technical malfunction, the auction will be paused. Any items sold prior to the malfunction will remain sold if the issue did not affect their sale. The auction will resume once the issue is resolved.
Bidders can participate by placing one bid at a time or by setting a maximum bid, allowing the system to automatically bid the lowest amount necessary on their behalf whenever they are outbid.
Each auction has a scheduled end time and date, but to prevent last-second “sniper” bids, any bid placed within the final 10 minutes will extend the auction by an additional 2 minutes.
8. Title and Risks
Ownership of the item transfers immediately to the buyer upon the final winning bid. At the time of title transfer, the buyer assumes all risks associated with the item, including but not limited to damage, malfunction, or loss.
The buyer is fully responsible for the item’s care, maintenance, and any potential damages or liabilities resulting from its use. This includes any loss or damage to property, as well as any injury caused by the item, the buyer, or the buyer’s representatives. The buyer agrees to hold USEDSPRAYDRONES.COM harmless from any such claims.
Title and risk are assumed by the buyer regardless of whether payment has been settled or delivery has been completed, including purchases made via phone or online.
9. Payment Liability, Default, and Security Interest
Any buyer issuing a pre-approved personal check or authorizing a credit card purchase assumes full liability for the transaction. Any returned checks or disputed credit card charges will be referred to legal authorities for prosecution. In addition to a $50 NSF fee, an additional $500 penalty will be applied to any returned check not repaid via wire transfer within one day of the return date.
Buyers who fail to complete payment for a purchased item will be considered in default. In such cases, the seller may resell the item at public or private sale without notice, with all resale costs charged to the defaulting buyer. If the resale does not fully cover the outstanding balance, the defaulting buyer remains responsible for the remaining amount and may face legal action. The buyer will also be liable for all costs incurred in the collection process, including attorney fees.
To ensure payment and cover any associated expenses, the buyer grants the seller a security interest and lien on the purchased item. This includes all related documents, registration certificates, and any proceeds associated with the item until full payment is received.
Furthermore, no registration certificates for purchased items will be released until payment has been received and fully cleared. This policy is strictly enforced with no exceptions. All related paperwork will remain in the possession of the seller until the buyer’s payment becomes unconditional and settled.
10. Post Sale Removal
All sold items must be removed from the seller’s property in a timely manner, as agreed upon between the buyer and seller. Items remaining on the seller’s property after the sale are the responsibility and risk of the buyer. Any delays in transport must be pre-approved by the seller, or the buyer may choose to pick up the item in person.
Each seller will coordinate with the buyer to arrange transportation at the buyer’s expense, which may involve working with a transport company for delivery to any state or Canada. International transport is also available at the buyer’s expense.
